Our client was traveling on her bicycle through a local restaurant's parking lot when she was injured by a steel cable that was strung across the lot by the valet company. The defendants claimed our client was not an invitee at the time because she was not a patron of the restaurant and was using the parking lot as a cut through on her way home. The defendants filed motions for summary judgment claiming that they owed a lower duty of care to the client based on her status upon the property. We were able to successfully argue against this defense at mediation and come to a favorable resolution of the case.
